1. Agreement to Terms
By accessing or using LeadSpark ("the Service"), operated by Questo ("we", "us", "our"), you agree to these Terms of Service. If using the Service on behalf of an organization, you represent authority to bind that organization.
2. Description of Service
LeadSpark is an AI-powered lead generation platform that provides automated content creation, multi-channel lead capture, AI lead enrichment, lead scoring, campaign management, affiliate tracking, and ROI analytics.
3. Account Registration
You must provide accurate information when registering. You are responsible for maintaining credential security and all activity under your account. Notify us immediately at support@questo.media if you suspect unauthorized access.
4. Subscription and Payment
- Pricing - Plans start at $149/month (Starter). Growth is $299/month. Enterprise pricing is custom.
- Billing - Subscriptions are billed monthly in advance via Stripe. We accept credit cards and ACH.
- Free trial - New accounts receive a 14-day trial with Growth features. No credit card required.
- No per-lead fees - All plans include unlimited leads and unlimited enrichment at the flat monthly rate.
5. Cancellation and Refunds
Starter and Growth plans are month-to-month with no cancellation fees. Cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds for partial months. Enterprise plans follow individual agreement terms.
6. Lead Data Ownership
You own all lead data captured and enriched through your account. We act as a data processor. Upon cancellation, you may export all lead data within 90 days. After 90 days, lead data is permanently deleted. We do not retain copies of your lead data after deletion.
7. Acceptable Use
- Comply with all applicable anti-spam laws (CAN-SPAM, GDPR, CASL)
- Do not use the Service to send unsolicited communications without consent
- Do not upload purchased or scraped contact lists without proper opt-in
- Do not use the platform for illegal, deceptive, or harmful purposes
- Do not reverse-engineer our AI models or enrichment processes
- Do not exceed reasonable API rate limits or abuse infrastructure
- Do not resell lead data or enrichment results as a standalone product
8. Content and Campaign Responsibility
You are responsible for the content of your campaigns, landing pages, and outreach messages. We do not pre-approve content but reserve the right to suspend accounts that send deceptive, abusive, or illegal content. Our AI content tools generate suggestions; you are responsible for reviewing and approving all content before distribution.
9. Affiliate Program Terms
Participation in the LeadSpark affiliate program is governed by these additional terms:
- Commissions are paid on verified conversions only
- Cookie tracking window is 30 days from last click
- Minimum payout threshold is $50 USD
- Self-referrals and fraudulent clicks are prohibited
- Commission rates may change with 30 days notice
- We reserve the right to revoke affiliate status for policy violations
10. AI Enrichment Disclaimer
AI-generated enrichment data is derived from publicly available sources and third-party providers. While we strive for accuracy, enrichment data may occasionally be incomplete or outdated. You should verify critical data points before making business decisions based solely on enrichment results.
11. Service Availability
We target 99.9% monthly uptime. Scheduled maintenance is announced at least 48 hours in advance. We are not liable for downtime outside our control.
12. Limitation of Liability
Questo's total liability shall not exceed fees paid by you in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages. We are not responsible for the success or failure of your lead generation campaigns or revenue outcomes.
13. Intellectual Property
You retain ownership of your content, campaigns, and lead data. We retain ownership of the LeadSpark platform, AI models, enrichment technology, and all proprietary systems. Content generated by our AI tools is licensed to you for commercial use within the platform.
14. Governing Law
These terms are governed by the laws of the State of Israel. Disputes shall be resolved in the competent courts of Tel Aviv-Jaffa, Israel.
